INNOVATOR visa

The Innovator visa category is for non-EEA nationals who are experienced business people seeking to establish a business in the UK. You will need to have £50,000 to invest in your business but make sure you can arrange additional funds since the stated amount is unrealistically low. In the case of a team of Entrepreneurs, each team member must have access to a minimum of £50,000. Under the new rules, applicants can rely on investments they have already made in their business, but only those made within 12 months of their application.

DETAILS

An applicant of a ‚Äúnew business‚ÄĚ must demonstrate the criteria of following separate categories to be endorsed:

Innovation: The applicant has a genuine, original business plan that meets new or existing market needs and/or creates a competitive advantage.

Viability: The applicant has the necessary skills, knowledge, experience and market awareness to successfully run the business.

Scalability: There is evidence of structured planning and of potential for job creation and growth into national and international markets.

Furthermore, the endorsing body must be satisfied that the applicant will spend their entire working time in the UK on developing business ventures.


You will need to stay in contact with your endorsing body with checkpoints at 6, 12 and 24 months after your application is successful. The endorsing body will need to be satisfied that you are continuing to work on your business venture and have demonstrated reasonable progress in relation to either your original or a new business idea that is innovative, scalable and viable. Your endorsement may be withdrawn and your leave curtailed if this is not the case.

Your partner and any children under the age of 18 may accompany or join you as your dependant(s). ‚Ä®

CRITERIA

You are at least 18 years old;

If you are applying to enter the Innovator visa category for the first time (either from overseas or in-country with leave as a Tier 1 Entrepreneur, Tier 2 General migrant, Tier 2 ICT migrant or Prospective Entrepreneur), you have at least £50,000 available to invest in your business or have already invested £50,000 in your business. You must also have been endorsed by an approved UK endorsing body that has positively assessed your new business idea for innovation, viability and scalability and is satisfied that you will spend your entire working time in the UK on developing your business venture;

You genuinely intend to undertake, and are capable of undertaking, any work or business activity in the UK stated in your application;

You do not intend to work in the UK other than for the business(es) you have established;

Any money which you claim is available is genuinely available and you intend to use it for the purposes described in your application;

You are competent in the English language to at least CEFR Level B2 (equivalent to IELTS 5.5 in reading, writing, listening and speaking);

You have at least £1,270 (additional to any investment funds required) available to support yourself without relying on public funds.

START UP VISA

Overview and Eligibility The UK Start Up Visa is a new visa category that has replaced the Tier 1 Graduate Entrepreneur visa program. Because of the endorsement requirement this visa may be difficult to come under at the moment. 

 You’re eligible for this visa if: You are not an European Economic Area EEA or Switzerland citizen. You want to set up a business in the UK*. To set up a business in Britain you must be endorsed by an authorized body that is either a UK higher education institution or a business organization with a history of supporting UK entrepreneurs.

Your stay in the UK 

 You can stay in the UK for two years on a Start-up Visa and you can bring family members, including a spouse or partner and children under the age of 18. 

You will spend the majority of your time in the UK developing your business, but you can work outside your business to support yourself. There is no option to extend your Start-up Visa after two years, but you can switch to the Innovator Visa to extend your stay in the UK and develop your business. The Innovator Visa is valid for three years, with the option to extend when it is due to expire. 

 After five years, you could be eligible to apply for indefinite leave to remain (UK settlement). Applying for a UK Start Up Visa You can only apply for the Start-up Visa, online. In addition, you will need to have your fingerprints and a photograph taken at a UK visa application centres in the country from which you are applying. You must do this to get a biometric residence permit, which is needed as part of your Start-up Visa UK application. 

¬†To support your application, you must provide a business plan and supporting documents for endorsement. Those endorsing your Start-up Visa application must be ‚Äėreasonably satisfied that you will spend much of your working time in Britain developing your business venture,‚Äô in accordance with UK immigration rules.¬†

CRITERIA

UK immigration rules specify the following, minimum requirements to be eligible for the Start-up Visa:

You must be at least 18 years old 

Your business or business idea must undergo an assessment by an approved body 

You must meet English language requirements 

You must provide evidence of personal savings to support yourself during your time in the UK

SKILLED WORKER VISA

SKILLED WORKER VISA

As discussed, it is possible for an individual to operate as a director and/or investor within a UK business under Work Permit visa. Visa holders are not able to hold more than 10% of shares in the company that is sponsoring them. Visa is granted for 5 years, after which time the applicant would be eligible to apply for the Indefinite Leave to Remain (Settlement). 

 Once the applicant has achieved ILR, they would be able to continue running the business without restriction. Applicants are also able to bring dependants with them to the UK, granted entry for the same length of time as the main applicant. The family members would be freely allowed to work or establish their own business in the UK.
